Who is collecting your information?

The Wish For Yellow website is operated by Wish For Yellow LLC, a limited liability company organized under the laws of Georgia with its principal place of business at  4279 Roswell Road, Suite 208 #110, Atlanta, Georgia 30342 (“Yellow”, “we,” “us,” “our” and “ours”).

What types of information do we collect?

We collect information in two general categories: personally identifiable information and non-personally-identifiable information.

How and when do we collect information?

We collect information that you actively provide to us, and we collect information about your use of our site through technologies such as cookies and web beacons (described further below).

We collect information about you when you register for an account or subscribe to any of our services.  When you register an account or subscribe to services, we collect information such as your name, your email, address, billing address, and telephone number. The personally identifiable information that we collect, however, may vary with each registration.  We will notify you of the collection of personally identifiable information at the time of your registration.

To process payments for services, we may require your name, address, phone number, email address, business name, billing address and credit card information. Where do we process and store your personally identifiable information?

Any personally identifiable information that we collect will be stored and processed in our servers located in the United States or in other countries. If you reside outside the United States, we may transfer your personally identifiable information outside your country of residence to the United States. We may also transmit, transfer or process your personally identifiable information through any country in the world as we consider necessary or appropriate (including to countries outside the EEA).

How do we secure your personally identifiable information?

We make commercially reasonable efforts to secure your personal information in accordance with industry standards and technology. All personally identifiable information and credit card transactions are processed through industry standard Secure Socket Layer (SSL) and transferred with at least 128-bit encryption.

As no data transmission over the Internet or method of data storage is 100% secure, we cannot warrant the security of any information you transmit to us. There is no guarantee that information may not be accessed, altered, copied, destroyed, or disclosed through a breach of our security safeguards.

How can you correct, amend, or delete your personally identifiable information?

You may change or update your personally identifiable information in any account that you establish on this site within the “Settings” area of the site. You will be requested to log-in and identify yourself prior to making any changes. If you update any of your information, we may keep a copy of the original information in our archives for uses consistent with this policy. Any information deleted may not be recoverable.

We require an email address from you when you register for our services or create an account. We do not send unsolicited email to you. We use email to: (a) Respond to email messages from you; (b) Confirm product or service orders placed by you; and (c) Engage in other communication that you have authorized or that we consider necessary to effectively service you. How do we comply with the Children's Online Privacy Protection Act (“COPPA”)?  

Our age restrictions for services are set forth in the Yellow User Agreement. Use of this site is limited to persons who are of legal age in the jurisdiction in which they reside.  Regardless of where you reside, you must be at least 18 to use this site.  We will not knowingly accept any information from children under the age of 13.  In compliance with the Children’s Online Privacy Protection Act (“COPPA”), any information we may receive from users we believe to be under the age of 13 will be deleted from our servers.

Is Yellow subject to the Health Insurance Portability and Accountability Act (“HIPAA”)?

Yellow is not subject to the Health Insurance Portability and Accountability Act (“HIPAA”). The Privacy and Security Rules of HIPAA apply only to covered entities (and their business associates). Covered entity means: (i) A health plan; (ii) A health care clearinghouse; or (iii) A health care provider who transmits any health information in electronic form in connection with transactions covered by HIPAA rules (45 CFR 160.103). Yellow is neither a covered entity nor a business associate of a covered entity; nor do we engage in the kind of transactions which HIPAA is meant to cover.

How do we notify you of changes to our privacy policy?

We reserve the right to modify this privacy policy at any time.  If we decide to modify our privacy policy, we will post the changes on this privacy policy page or send you a notice via email. You will be responsible for reviewing any such modifications. If you object to any of the changes to our privacy policy, and you no longer wish to use our site or services, you may close your account via “Settings”. Your continued use of our site or services following posting of the updated privacy policy will constitute your acceptance of the changes.

If we materially change our privacy policy to make it less protective of personally identifiable information collected from you in the past, we will obtain your consent before implementing those changes with respect to such information.
